FS Local Government Summit - A Call For Leadership and Oversight

As the Free State Local Government commences from the 3-5 December 2024, it is important that municipal councils rise to the occasion and exercise their oversight role effectively. The lack of adherence to compliance directives issued by the MEC for CoGTA must end. The monitoring and evaluation mechanisms for municipal performance, as mandated by Section 105 of the Municipal Systems Act, must be strengthened. Provinces must fulfill their constitutional obligation to support and strengthen municipal capacity, as outlined in Section 154(1) of the Constitution.

The District Development Model (DDM) offers a framework for integrated planning and execution. However, its potential remains unrealized due to a lack of commitment and understanding at both the administrative and political levels. The Mangaung Metropolitan Municipality must lead the charge in implementing DDM, setting an example for other municipalities.

MUNICIPAL SUPPORT AND INTERVENTIONS

The persistent issues of maladministration, irregular appointments, non-payment of salaries, and failure to address third-party obligations such as pensions and medical aid contributions are symptoms of systemic governance failures. These practices are not only unlawful but also erode trust in municipal administration.

Court judgments, such as the recent Matjhabeng ruling, highlight the judiciary’s increasing role in directing government action—a role that should be unnecessary if municipal councils and administrations functioned as intended. We must prioritize the development and execution of Municipal Support and Intervention Plans (MSIPs) to prevent such scenarios.
